To determine whether mediation is a good fit for your family law case, it is important to first understand the mediation process. Mediation is a process by which parties are able to resolve disputes through a meeting or series of meetings with a neutral third party, but both sides need to agree to participate in the mediation process. The neutral third party helps the parties reach an amicable resolution of the issues. At Steven Krieger Law, our most experienced attorneys serve as the neutral third party. The neutral third party does not give either party legal advice but instead helps the parties explore creative solutions to their problems that may not be available in a court proceeding. The mediator offers the parties the opportunity to discuss their issues together without judgment or blame.
If an agreement is reached, an SKL mediator will prepare the written agreement for the parties. The parties can then take the agreement to counsel of their own choosing for review and consultation prior to signing it, but this is not required. Mediation is available for parties at any stage in their dispute: from parties who have agreed on many issues but have one or two issues still in dispute to parties that have nothing agreed upon, but
are open to discussing their issues in an effort to reach a resolution. Ideally, mediation is a for parties who are amicable with one another but need assistance in reaching an agreement and ensuring the agreement addresses all issues, is prepared properly, and will be enforceable.
